Auction Terms & Conditions
All Bidders must create an online account or register in person prior to bidding.
BUYER'S PREMIUM SCALE:
10% capped at $4,000 per item on DuBoisAuctionCo.com.
12.5% capped at $5,000 per item on all third-party bidding platforms, including but not limited to Proxibid and EquipmentFacts.
Buyer’s Premium caps vary by platform and will be disclosed in each individual auction listing.
NECESSARY DOCUMENTS:
Driver’s License/Government ID and Tax Exemption Form (Re-sale/Farm), if applicable, must be provided at registration.
PAYMENT TERMS:
All invoices must be paid in full no later than two (2) business days following the close of auction. Auctioneer reserves the right to require a deposit of up to $2,500 or 10% of the total purchase price (whichever is greater) at auction close.
Accepted payment methods include Cash (USD), Cashier’s Check, ACH Transfer, Wire Transfer (with $25 fee), and Credit Card (up to $2,500 with 3.5% processing fee).
All buyers outside the continental United States must pay by wire transfer.
Invoices unpaid after two (2) business days shall incur a $100 per day administrative late fee until paid in full. If Buyer fails to remit payment within the required two (2) business day period, Auctioneer is expressly authorized to charge the credit card on file for the full outstanding invoice balance, including buyer’s premium, taxes, administrative fees, storage fees, and any other amounts due under these Terms.
CREDIT CARD AUTHORIZATION & VERIFICATION:
Auctioneer accepts all major credit cards except American Express.
Auctioneer requires a valid credit card verification prior to approval of bidding privileges.
By registering to bid, Buyer authorizes Auctioneer to place a pre-authorization hold of $250 on Buyer’s credit card for verification purposes.
CREDIT CARD CHARGEBACK WAIVER:
By registering to bid, Buyer expressly authorizes Auctioneer to charge the credit card on file for any unpaid balance, fees, taxes, storage charges, administrative costs, or other amounts due under these Terms. Buyer agrees not to initiate or permit any credit card chargeback, reversal, or payment dispute related to any valid auction transaction.
In the event Buyer initiates a chargeback in violation of these Terms, Buyer shall remain fully liable for all amounts due, including chargeback fees, administrative expenses, collection costs, and reasonable attorney’s fees incurred by Auctioneer.
ITEMS IN VARIOUS LOCATIONS:
Certain items may be located at different sites. Buyers are responsible for reviewing the lot description carefully to determine the specific location of each item.
REMOVAL & RISK OF LOSS:
All items must be paid for in full prior to removal. Partial payments and/or partial release of lots will not be permitted under any circumstances.
Removal must be completed no later than the final published pick-up date for the specific auction. Buyers are responsible for reviewing each auction listing for applicable removal deadlines.
Failure to remove items by the final pick-up date shall constitute default under these Terms of Sale. In such event, Auctioneer reserves the right, without further notice, to resell the property and pursue all remedies available under these Terms and applicable law.
Risk of loss passes at the time a bid is confirmed and accepted by the Seller/Auctioneer.
REMOVAL INDEMNIFICATION:
All shipping, transportation, and removal of purchased items is solely the responsibility of the Buyer. Buyer shall indemnify, defend, and hold harmless Auctioneer and Seller from and against any and all claims, injuries, death, property damage, environmental damage, regulatory violations, fines, penalties, or liabilities arising from or related to Buyer’s shipping, dismantling, loading, rigging, cutting, transport, storage, export, or removal of any purchased item.
FIREARM SPECIFIC TERMS:
All Federal and Louisiana laws apply.
Firearms must ship to a valid FFL dealer.
Buyer must provide receiving FFL documentation.
Bidder must be 21 years of age or older.
If unable to pass background check, DO NOT BID.
EXPORT CONTROL & SANCTIONS:
Buyer represents and warrants that neither Buyer nor any of its officers, directors, shareholders, members, managers, partners, employees, agents, or affiliates is currently listed on any U.S. government restricted party list.
Buyer agrees not to export or re-export any purchased item in violation of U.S. export laws.
Buyer assumes full responsibility for export compliance and indemnifies Auctioneer and Seller.
MARKETING COMMUNICATIONS: By registering to bid and accepting these Terms and Conditions, each Bidder expressly consents to receive marketing and promotional materials from DuBois Auction Co., including but not limited to upcoming auction announcements, newsletters, and other promotional communications, delivered via email, mail, text, or other means of contact provided at registration. Bidders may opt out of receiving such communications at any time by contacting DuBois Auction Co. directly.
SPECIAL TERMS:
1. Registration and bidding constitute legally binding acceptance of these Terms.
2. The highest bid accepted by the Auctioneer shall be the purchaser. Auctioneer reserves the right to reject bids, reopen bidding, withdraw items, correct clerical errors, void sales, or cancel the auction.
3. CONDITION OF SALE:
ALL ITEMS ARE SOLD “AS IS, WHERE IS, WITH ALL FAULTS.”
Auctioneer and Seller make no warranties, express or implied, of any kind regarding the condition, merchantability, fitness for a particular purpose, title, age, year of manufacture, model, make, compliance with any applicable law or regulation, or financeability of any item. All catalog information is provided as a guide only and, while believed to be reliable, is not guaranteed or warranted; no sale shall be invalidated due to any inaccuracy therein. By participating in the auction, each bidder confirms they have independently inspected all items, are not relying on the Auctioneer or Seller for any representations, and expressly waive any and all claims against DuBois Auction Co. or its affiliates, including those related to repairs, restoration, or replacement of parts.
4. NO RELIANCE:
Buyer acknowledges that neither Auctioneer nor Seller has made any representation not expressly set forth herein.
5. SELLER BIDDING DISCLOSURE:
Auctioneer may execute bids on behalf of Seller up to the reserve amount as permitted under Louisiana law.
6. TITLE DOCUMENTS:
The following applies only to items for which a title document exists and has been disclosed as available prior to sale. For titled items, all available title documents will be delivered immediately upon payment in full, or mailed within ten (10) banking days of receipt of payment. Cash or certified funds are required for the release of title documents. In the event the Auctioneer or Seller is unable to provide clear title, whether before or after delivery, their sole liability shall be limited to a refund of monies paid, upon the Purchaser's return of the item. Taxes will not be charged for Titled vehicles for which taxes will be collected at registration. The Buyer is responsible for payment of Titled vehicle tax payments.
7. DEFAULT:
Auctioneer may retain deposits, resell items, recover deficiencies and costs, assign to collections, charge storage, pursue specific performance, and permanently ban Buyer.
8. BIDDING PLATFORM & CLERICAL ERRORS:
Auctioneer shall not be responsible for missed bids, bidding platform failures, or clerical errors.
9. LIMITATION OF LIABILITY:
Auctioneer’s maximum liability shall not exceed the purchase price paid.
10. CLASS ACTION WAIVER:
Buyer waives any right to participate in a class action lawsuit.
11. FORCE MAJEURE:
Auctioneer shall not be liable for delays caused by events beyond reasonable control.
12. SITE SAFETY:
Auction sites may contain hazardous conditions. Attendance is at own risk.
13. ENTIRE AGREEMENT:
These Terms constitute the entire agreement between Buyer, Seller, and Auctioneer.
GOVERNING LAW & VENUE:
These Terms shall be governed by the laws of the State of Louisiana.
Any legal action shall be brought exclusively in the State or Federal Courts located in Franklin Parish, Louisiana.
